Job Description

Johnson Service Group is looking for a General Counsel for one of our Clients in Sacramento.  This position involves initiating and supporting litigation cases and issues of statewide significance to California school districts, county offices of education, and ROC/Ps, consistent with Client’s mission, priorities, and strategic direction.  This person will oversee the HR Department.  The legal department provides support to Client’s members and leadership teams and provides corporate legal support for other departments.

Responsibilities:
 
    • Provides legal advice and counsel on Association business and contractual matters.
    • Provides litigation support and management and compliance with corporate formalities and Association obligations; provides full legal support to all business units in managing their legal risks about contract administration and capital project planning.
    • Provides legal support for project development, including the drafting and review of letters of intent, option agreements, purchase agreements and consultant contracts.
    • Provides counsel and support to compliance matters to ensure regulatory requirements, statutes, rules, and regulations are followed.
    • Participates in and makes presentations to the Board of Directors, the Delegate Assembly, and a wide variety of committees, and boards; performs review of matters in areas of expertise pertaining to Client’s governing bodies and advisory committees.
    • Interprets the impact of legislation, proposed legislation, regulations, and court decisions on Client member districts and provides guidance and written materials on impact and implementation.
    • Provides legal support to all Client departments and related entities, including reviewing proposed sample board policies and administrative regulations developed by the Policy Services Department.
    • Remains current on developing issues and changes in rules or law to inform and help Client members on impact and implementation.
    • Provides oversight to the Human Resources division.
    • Oversees the operations of the Education Legal Alliance.
    • Conducts legal research, prepares documents, and advises Client staff and leadership.
    • Oversees the Department and ELA budget.
    • Develops content for publications and presentations regarding legal issues to Client members and others.
    • Responds to requests for information and questions on legal issues from Client board members and others.
    • Demonstrates an understanding and adherence to Client values, policies, and practices.
    • Demonstrates respect, honesty, and professionalism always.
    • Occasional overnight travel to staff off-site functions.
    • Overall supervisorial responsibilities of this position include, but may not be limited to, interviewing, training, timekeeping and wage & hour management, planning, assigning, directing work, appraising performance, rewarding, and disciplining employees, and addressing and resolving complaints.
    • Performs other duties as assigned.

Qualifications:
 
    • Juris Doctorate degree; licensed to practice law in California. Admission to California’s Federal District Courts preferred.
    • 7 to 10 years practicing law, including experience working in education law and labor and employment law, or a combination of practicing education law that includes direct experience in the area(s) of labor and employment.  General/In-House Counsel is preferred.
    • A combination of practicing law and experience in the area(s) of education and non-profit law and litigation for corporations, plus seven (7) years of supervisory and/or administrative experience is preferred.
    • Active member in good standing with the State Bar of California.
    • Knowledge of the laws of the California public education system.
    • Principles and practices of budget development and administration; employee supervision, either directly or through subordinate levels of supervision, including work planning, assignment, review and evaluation, and the training of staff in work procedures; contract management; and researching issues, evaluating alternatives, making sound recommendations, and preparing and presenting effective staff reports; and general principles of risk management related to the functions of assigned areas.
    • Organization and management practices as applied to the development, analysis, and evaluation of programs, policies, and operational needs of assigned functional areas.
    • Techniques for effectively representing the Association in state and federal courts, contacts with governmental agencies, community groups, and various business, professional, educational, regulatory, and legislative organizations; techniques for providing a high level of customer service by effectively dealing with the public, vendors, contractors, and Association staff.
    • Able to develop and implement goals, objectives, policies, procedures, work standards, and internal controls for the department and assigned program areas.
    • Prepare and administer large and complex budgets; allocate limited resources in a cost-effective manner.
    • Select, train, motivate, and evaluate the work of staff and train staff in work procedures.
    • Interpret, apply, explain, and ensure compliance with Federal, State, and local policies, procedures, laws, and regulations.
    • Effectively administer special projects with contractual agreements and ensure compliance with stipulations; effectively administer a variety of programs and administrative activities.
    • Conduct effective negotiations and effectively represent the Association and the department in meetings with governmental agencies, contractors, vendors, and various business, professional, regulatory, and legislative organizations related to elected officials that make up Client's diverse membership.
    • Conduct complex research projects, evaluate alternatives, and make sound recommendations.
    • Must be able to sit at computer for long periods of time and have the dexterity to access, enter, and retrieve data using a computer keyboard or calculator, and operate standard office equipment.
    • Use of the English language to effectively communicate in person, over the telephone, and in writing.
    • Use tact, initiative, prudence, and independent judgment within general policy, procedural and legal guidelines; establish, maintain, and foster positive and effective working relationships with those contacted while performing duties and responsibilities.
    • Must possess mobility to work in a standard office setting and use standard office equipment, including a computer; vision to read printed materials and computer screen, and hearing and speech to communicate in person, and over the telephone to present information to a group;
    • in the execution of duties.
    • Employee must be able to bend, stoop, kneel, reach, push and pull drawers open and closed, lift, carry, objects weighing up to 50 pounds, hand truck available to assist.
    • Must be able to travel with some overnight stays on occasion throughout the state of California.
    • Work occasional evenings, nights, weekends, and holidays for activities that are required to be done after-hours.
    • Can limit vacation during peak periods.
Salary starting at $200,000 DOE
